AGORED SOUNDS is a metal-focused sample library and creator platform operated by Agored Records.

The Platform is intended for producers, musicians, and creators working in metal and heavy sub-genres, as described on the About and FAQ pages.

You must be at least 16 years old (or the minimum age required in your country to consent to data processing and online services) to use the Platform.

You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account.

We may refuse, suspend, or terminate access if we reasonably believe you have violated these Terms or applicable law.

You may register with an email address and password. Authentication and session management are handled through our infrastructure providers.

You may not share your account, sell access to your account, or use another person's account without permission.

We may offer free and paid membership tiers with different limits on downloads, uploads, previews, and creator features, as described on the Pricing and FAQ pages.

We collect and process personal data only as needed to operate, secure, and improve the Platform. We do not sell your personal data to advertisers.

Depending on how you use the Platform, we may process the following categories of data:

• Account data: email address, hashed password, user ID, display name, avatar, public profile information, creator application details, and showcase links you choose to provide.
• Content & activity data: samples, packs, presets, MIDI, comments, likes, follows, download history, play statistics, upload metadata, and moderation records.
• Payment-related data: subscription status, Stripe customer identifiers, purchase records for Sample Packs, and payout information for certified creators connected via Stripe Connect. We do not store full payment card numbers on our servers.
• Communications: support tickets, messages you send to us, and administrative correspondence.
• Technical data: IP address, browser or app type, device information, and security logs (including rate-limiting and abuse-prevention data).

We use personal data to provide the service you request: hosting your account, delivering downloads and previews, processing subscriptions and Sample Pack purchases, running the creator program, moderating content, sending transactional emails, and responding to support requests.

We also use data to secure the Platform (fraud prevention, rate limiting, access control), comply with legal obligations, and improve features and performance.

Public profile fields you choose to display (such as display name, avatar, bio, and social links) may be visible to other users.

• Authentication & database hosting: Supabase.
• Payments & creator payouts: Stripe (including Stripe Connect for certified creators).
• Application hosting & delivery: Vercel.
• Transactional email: Resend (or equivalent email delivery providers we configure).
• Distributed rate limiting & security: Upstash Redis (when configured).
• Desktop app updates & distribution: GitHub Releases (for the AGORED SOUNDS desktop application).

We retain personal data for as long as your account is active and as needed to provide the Platform, resolve disputes, enforce these Terms, and meet legal obligations.

We apply reasonable technical and organizational measures to protect data, including access controls, encrypted connections (HTTPS), and provider-level security. No online service can guarantee absolute security.

If you are located in the European Economic Area or another jurisdiction with similar laws, you may have rights to access, rectify, erase, restrict, or port certain personal data, and to object to or withdraw consent for certain processing where applicable.

To exercise these rights or request account deletion, contact studio@agoredcorpse.com. We may need to verify your identity before acting on a request.

We may update our data practices as the Platform evolves. Material changes will be reflected in these Terms or in a dedicated privacy notice when appropriate.

Premium membership and certain purchases are processed through Stripe. By subscribing or buying a Sample Pack, you also agree to Stripe's applicable terms and privacy policy.

Prices, billing intervals, and included features are shown on the Pricing page at the time of purchase. We may change pricing for new subscriptions with reasonable notice; existing billing periods are generally honored until renewal unless otherwise stated.

Subscriptions renew automatically until cancelled through your account billing portal or Stripe customer portal, where available.

You are responsible for any taxes, bank fees, or currency conversion charges imposed by your payment provider.

Except where required by applicable consumer protection law, membership fees and Sample Pack purchases are generally non-refundable once access has been granted or a digital download has been delivered.

If you believe a charge was made in error (duplicate charge, unauthorized payment, or technical failure), contact studio@agoredcorpse.com promptly with your account email and transaction details. We will review good-faith requests on a case-by-case basis.

Nothing in these Terms limits mandatory refund rights you may have under French or EU consumer law where they apply.

AGORED SOUNDS is a platform that connects creators and listeners. We are not a party to private agreements, collaborations, licensing deals, or commercial relationships between users.

If a dispute arises between users (including but not limited to Sample Pack purchases, quality of content, crediting, royalties, collaborations, or alleged misuse of downloaded material), the parties must resolve it directly between themselves.

We do not mediate, arbitrate, or guarantee outcomes in disputes between users, except where we choose to do so at our sole discretion (for example, removing content that clearly violates these Terms).

You release Agored Records from claims, demands, and damages arising out of disputes with other users, to the fullest extent permitted by law.

Certified creators may sell Sample Packs through the Platform subject to approval, Stripe Connect onboarding, and our creator guidelines.

Creators set prices within limits we publish. Revenue shares (for example, the creator/platform split described on the FAQ) apply as stated at the time of sale.

Creators are independent sellers. Agored Records facilitates listing, payment processing, and delivery infrastructure but does not employ creators and does not guarantee sales volume or income.

Creators are solely responsible for the accuracy of their listings, pack descriptions, and the legality of the content they sell.

You retain ownership of the samples, packs, presets, MIDI, images, text, and other material you upload ("User Content"), subject to the licenses you grant below.

By uploading or publishing User Content, you represent and warrant that:

• You are the creator of the content, or you have obtained all necessary rights, licenses, permissions, and consents to upload, distribute, and sell it on the Platform.
• Your User Content does not infringe any copyright, trademark, publicity right, privacy right, or other intellectual property or personal right of any third party.
• Your User Content does not contain unauthorized samples, loops, stems, recordings, or other material taken from commercial releases, other libraries, or third parties without permission.
• You have the authority to grant the licenses described in these Terms.

By uploading User Content, you grant Agored Records a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transcode, generate previews, index, display, distribute, and make available your User Content to other users through the Platform, solely for operating and promoting the Platform and the metal sample library.

This license includes the right to use your display name, avatar, and public profile information in connection with your uploads (for example, on asset pages and creator profiles).

You may remove eligible content by deleting it where the Platform allows, or by contacting support. We may retain backups or copies for a limited period for security, legal compliance, or dispute resolution.

The license ends when your content is removed from active distribution, except for copies reasonably retained in backups or where retention is required by law.

Unless you specify otherwise in a paid Sample Pack listing or separate written agreement, samples and free library content made available for download are licensed to other registered users for use in their own musical productions (personal and commercial), not for redistribution as standalone sample files.

Users may not resell, re-upload, sublicense, or redistribute downloaded content as a competing sample library or pack, nor use it to train machine-learning models for generating audio, except where explicitly permitted by the uploader or applicable law.

Sample Pack purchases may include additional terms stated on the pack page. In case of conflict, pack-specific terms apply to that purchase.

You agree not to:

• Upload content you do not have the right to distribute.
• Infringe copyrights, trademarks, or other intellectual property rights.
• Upload malware, spam, or content designed to disrupt the Platform.
• Harass, threaten, impersonate, or dox other users.
• Circumvent download limits, paywalls, or security measures.
• Scrape, bulk-download, or mirror the library without written permission.
• Use the Platform for unlawful purposes or to facilitate fraud.

We may review, approve, reject, remove, or restrict access to any User Content at our discretion, including for moderation, quality control, legal compliance, or security.

If you believe content on the Platform infringes your rights, contact studio@agoredcorpse.com with: (a) identification of the work claimed to be infringed, (b) identification of the material on the Platform, (c) your contact information, (d) a statement of good-faith belief, and (e) a statement that the information is accurate and you are authorized to act on behalf of the rights holder.

We may remove or disable access to reported content and notify the uploader. Repeat infringers may have their accounts terminated.

AGORED SOUNDS acts as an intermediary hosting service. We are not obligated to monitor all uploads in advance, but we respond to valid complaints and enforce these Terms.

You agree to defend, indemnify, and hold harmless Agored Records, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your User Content, including any allegation that it infringes third-party rights.
• Your use of the Platform in violation of these Terms or applicable law.
• Your dispute with another user.
• Any false representation you make about ownership or rights in uploaded content.

The Platform and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, error-free operation, or that every upload is free of third-party claims. You use downloads and User Content at your own risk.

To the fullest extent permitted by law, Agored Records shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform.

Our total liability for any claim relating to the Platform shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) €50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

You may stop using the Platform at any time. You may request account deletion by contacting studio@agoredcorpse.com.

We may suspend or terminate your account immediately if you breach these Terms, if we are required to do so by law, or if continued access poses a security or legal risk.

Upon termination, your right to use the Platform ends. Sections that by nature should survive (including intellectual property, indemnification, disclaimers, limitation of liability, and governing law) will survive termination.

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the latest version.

Material changes will be communicated through the Platform or by email where appropriate. Continued use after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of France, without regard to conflict-of-law principles.

If you are a consumer residing in the European Union, you may also benefit from mandatory protections of the laws of your country of residence.

Unless mandatory law provides otherwise, courts in Paris, France shall have exclusive jurisdiction over disputes relating to these Terms or the Platform.
